DRP Law News Update. The Constitutional Court of the Republic of Indonesia published a decision update on the scope of advocates’ immunity rights under Article 16 of Law No. 18 of 2003 on Advocates.
In Decision No. 108/PUU-XXI/2023, the Court rejected a judicial review petition concerning the interpretation of advocates’ immunity. The Court emphasized that immunity is not absolute and depends on whether an advocate acts in good faith while carrying out professional duties.
The decision is relevant to litigation practice, professional ethics, and legal risk management because it confirms that advocates must continue to observe the code of ethics and applicable laws when defending clients, both in and outside court-related work.
The official MKRI news report also records that Deddy Rizaldy Arwin Gommo appeared as legal counsel for the Petitioner in the proceedings concerning the advocate immunity issue.
